IMPORTANT INFORMATION
 
  • Only antiques, collectibles or vintage items may be sold (at least 30 years old). - NO NEW MERCHANDISE PERMITTED
  • Only 1 vehicle per space. A trailer requires a 2nd space. (Spaces are 19 feet wide by 16 feet deep).
  • The event is held rain or shine. THERE ARE ABSOLUTELY NO REFUNDS OR EXCHANGES

 

                                                                                                             

SELLER RULES AND REGULATIONS

These are the terms under which you are allowed to sell at the event.


1 - SET UP AND MOVE OUT - Seller set up is between 5:30 and 6:45am. Sellers must be in their spaces by 6:45 am. Absolutely no vehicles may enter the sellers area after 6:45am. Gates are open to the public from 5:30am to 2:00pm. Sellers may not begin packing before 2:00pm and may not exit the show before 3:00pm. All sellers must be off the premises by 5:00pm.
 

2 - REFUNDS - There are absolutely no refunds, exchanges or rain checks given for any reason whatsoever! Tickets lost or stolen will not be replaced or refunded. If you are not in your space by 6:45AM your space will be resold and you will not receive a refund.
 

3 - SELLING SPACES - Each selling space is approximately 19 feet wide (frontage) and 16 feet deep. NO vehicles longer than 19 ft. will be permitted in this space. Any vehicle longer than 19 ft. requires a 2nd permit. .A trailer is considered a 2nd vehicle and requires an additional permit for entry.
     A- ONLY ONE vehicle will be allowed to enter with Sellers Permit. Absolutely no re-entry is permitted. Sellers may leave one vehicle in their space during the event, or they may drop off Merchandise in their space and park their vehicle in the customer parking lot. Seller may not bring his vehicle back into sellers area until 3:00pm.
     B -TRUCKS Sellers renting or bringing trucks must make certain that the truck measures no more than 17 ft. bumper to bumper which includes the box cargo area and the cab. Include the ramp size when calculating the length of the vehicle.

 

4 -SPACE ASSIGNENTS - Seller spaces are assigned by Americanas parking staff upon entry. Only sellers with a specific space location designated on their Sellers Permit will receive that assigned space. All items for sale must be placed within the designated space markings and all aisles must be kept clear.
 

5 - THIS EVENT WILL BE HELD RAIN OR SHINE regardless of ALL weather conditions. NO REFUNDS WILL BE GIVEN in the event of natural disaster, earthquake, civil disturbance, acts of terrorism or Inclement weather .In the event of rain all dealers are required to stay in their spaces and MAY NOT MOVE THEIR VEHICLES or leave the selling area prior to 3:00PM.
 

6 - TRANSFERENCE OF SELLERS PERMIT - No person shall transfer, sell, resell or offer to sell or resell their sellers permit. Entry will be denied to any person using this permit who did not purchase it directly from Americana.This sellers permit may not be assigned or transferred to another person for any reason whatsoever.
 

7 - HELPERS - No more than 2 helpers will be admitted with this permit (between the hours of 5:30AM and 6:45AM only) and MUST ENTER WITH THE SELLER. Helpers arriving after 6:45AM must pay regular admission.
 

8 - NO FOOD,  BEVERAGE, gas filled balloons, guns, ammunition, fireworks, contraband, pornography, animals or animal parts may be offered for sale. Seller will not use the space for games, fires, sideshows or illegal purpose. No loud music or amplified voice equipment are permitted.
 

9 - CUSTOMER REFUNDS - If a customer requests a refund for an item purchased from a seller at this event, Seller may be required to give customer a full cash refund, at the sole discretion of Americana.
 

10 - CLEAN UP - Seller will place all trash in trash receptacles prior to leaving or seller will be required to pay Clean up costs. Trash, boxes, cigarette butts, and all other debris may not be left on the grounds
 

11 - MERCHANDISE - Only antiques and/or collectibles may be sold at this event. NO NEW MERCHANDISE PERMITTED! All items must be at least 20 years old and any new or inappropriate items must be removed at the discretion of Americana. All goods offered for sale are subject to inspection by law enforcement agencies.
 

12 - CALIFORNIA SELLERS PERMIT - All regular sellers are required by law to have a California Sellers Permit. Occasional sellers may sell twice in a 12 month period without a Sellers Permit.
 

13 - PETS - No pets are allowed. Sellers are not permitted to bring pets, even if they remain in a vehicle.
 

14 - CANOPIES/SUPPLIES - Seller must supply his own tables, chairs, canopies, etc. There is no electricity and no generators are allowed. All sellers setting up a canopy in a space must have it properly anchored and/or weighted. Americana reserves the right to require the seller to take it down at any time due to windy conditions.
 

15 - NO LITERATURE OR PRINTED MATERIAL of any kind may be distributed to dealers or customers without prior written consent of Americana.

Seller further agrees that their own image and/or images of their merchandise may appear in print, TV, and on the  internet, and by selling at this event enters into a full release for these purposes.
 

16 - AGREEMENT- Sellers payment and/or use of this permit acknowledges that the seller accepts and agrees to adhere to all of the terms and conditions set forth on both sides of this sellers permit and all rules appearing on the Americana web site. Americana reserves the right to revoke the license granted by this ticket and to reasonably refuse service and/or booth rental to anyone, or to require any vendor to leave. Americana reserves the right to formulate additional rules and regulations if necessary and each seller shall Abide by such additional rules and regulations.
 

17 - COMPLIANCE - Americana Enterprises, Inc. reserves the right to restrict and evict any Seller for non-compliance with rules and regulations as stated herewith, or any Seller whose method of operation distracts from the integrity of the event without refund to seller. No Seller shall conduct his business so as to interfere with or disturb others. Failure to comply with any of the rules stated herewith shall be grounds for eviction from this event without refund and the denial of issuance of future Sellers Permits. The Issuance of one Sellers Permit shall not convey a right to the issuance of future Sellers Permits.
 

18 - LIABILITY - Seller is aware that Americana Enterprises, Inc. does not guarantee the safety or security for the person or property of sellers employees at its outdoor antique markets. Seller assumes all risk of personal injury and loss of property. Seller agrees to indemnify and hold harmless Americana Enterprises, Inc. against any and all claims and causes of action arising out of: (1) personal injury to, or loss of property of seller or any of sellers employees or (2) sellers activities in connection with space rentals from Americana. the provisions of this section shall apply on all occasions commencing with this event and all subsequent events produced by Americana.
